These terms apply to the Funzone subscription advertised on this domain, for customers with a Swiss mobile subscription.

The short version: the service costs CHF 15 per week, it is charged through your mobile operator, it renews weekly, and you can stop it whenever you like. Everything below spells that out.

Who these terms are between

This website, funzone-ch.com, is an advertising domain operated by Jess Media B.V., Spoorhaven 44-46, 2651 AV Berkel en Rodenrijs, Netherlands, registration number 74876945.

The subscription itself is concluded on the signup page of your mobile operator. These terms govern the service advertised here and the relationship between you and Jess Media B.V. Your operator’s own conditions apply to the billing relationship you have with them.

By subscribing you confirm that you are at least 18 years old, or that you have the permission of the person who pays the phone bill.

What the service is

Funzone is a subscription to a catalogue of browser games, currently 554 titles across 10 categories. The games run in a standard web browser; no software is installed on your device.

The catalogue changes over time. Titles are added, and occasionally a title is withdrawn because the licence for it ends. The subscription is to the catalogue as a whole, not to any individual title, so the withdrawal of a single game is not a reduction of the service.

Access requires an internet connection and a reasonably current browser. We do not guarantee that every title works on every device or browser version ever released.

Price and billing

The price is CHF 15 per week.

  • Sunrise: CHF 15 per week, billed as one item.
  • Salt: CHF 15 per week, billed as three SMS charges of CHF 5.

The amount is charged by your mobile operator, either on your monthly invoice or against your prepaid balance. Your own plan’s SMS and data charges apply on top, exactly as they do for any other use of your phone.

All prices are in Swiss francs and include any applicable Swiss VAT.

Term, renewal and cancellation

The subscription starts when you confirm it on your operator page and runs for one week. It renews automatically for further weekly periods until it is cancelled.

You may cancel at any time, with no notice period and no cancellation fee. Send STOP to 995 by SMS, or email contact@funzone-ch.com from the mobile number the subscription runs on.

Cancellation takes effect at the end of the period already paid for. Access remains open until then, after which nothing further is charged. Periods already started are not refunded on a pro rata basis.

We may suspend or end a subscription if it is being used fraudulently, if charges are repeatedly reversed, or if the operator relationship that carries the billing ends.

Your rights as a consumer

Nothing in these terms limits the rights you have under mandatory Swiss consumer law, including the Federal Act against Unfair Competition, or under the rules your mobile operator applies to premium services.

Swiss law does not give a general right of withdrawal for contracts concluded by distance communication of this kind. We compensate for that with the cancellation terms above: no minimum term, no notice period, and a subscription you can stop the same day you start it.

Intellectual property

Game titles, cover art, characters and trademarks belong to their respective rights holders. The subscription gives you a personal, non-transferable right to play the games through the service for as long as it is active.

It does not give you the right to download, copy, reverse engineer, redistribute or publicly perform any title, or to use the games commercially.

Acceptable use

The subscription is for personal use by one person. Sharing access, automating play, interfering with the service, or attempting to reach parts of it you have not subscribed to are all grounds for ending it.

Liability

The service is provided as it stands. We take reasonable care to keep it available, but we do not promise uninterrupted access: maintenance happens, networks fail and browsers change.

To the extent Swiss law permits, liability is limited to the amount you paid for the subscription in the three months before the event complained of. Liability for death or personal injury, for intent, and for gross negligence is not excluded, because it cannot be.

Changes to these terms

We may amend these terms, for example when the offer, the operators or the law change. The current version is always the one published on this page, with the date of last update at the top.

If a change materially disadvantages you, you are free to cancel before it takes effect, on the same terms as any other cancellation.

Privacy

Personal data is handled as set out in our privacy policy, which explains what is collected on this website, what your mobile operator handles instead, and what rights you have under Swiss data protection law.

Governing law and disputes

These terms are governed by Swiss law. If you are a consumer resident in Switzerland, you keep the protection of the mandatory provisions that would apply in any case, and you may bring proceedings at the court of your place of residence.
